1. PURPOSE OF THE CONTRACT
These General Terms and Conditions of Sale (GTCS) apply in their entirety and without reservation to all subscriptions concluded by the Club de sport & spa de la Fondation with Customers and Members; they are inseparable from the subscription contract signed by each Member.
This Contract defines the terms and conditions of access to the la Fondation s Sports & Spa Club; it authorizes Members and Customers to use the Sports Hall and climbing wall for individual sports activities, as well as for group classes led by qualified sports advisors; access to the SPA is also included, comprising a swimming pool, steam room and sauna.
In addition, fee-paying treatments can be booked at the SPA, as well as individual coaching sessions, with La Fondation coaches only.
As part of the subscription formulas defined in this Contract, the Member may access the Gym and SPA according to the opening hours displayed at reception, and take part in group classes. Any participation in a class must be reserved in advance on the website of the Club de sport & spa de la Fondation , according to a non-contractual schedule.
The Club de sport & spa de la Fondation reserves the right to modify its general terms and conditions of sale and to inform the Customer within a reasonable period of time.

2. SUBSCRIPTION FORMULAS AND PAYMENT TERMS
2.1 : Subscription formulas
The Club de sport & spa de la Fondation offers three membership packages:
1. 12-month annual subscription
- 12-month firm commitment.
- No tacit renewal
2. monthly subscription - 12-month commitment
- Initial commitment: 12 months.
- Tacit renewal by monthly period
- Cancellation option from the 2nd year with 2 months' notice.
3. monthly subscription - 3-month commitment
- Initial commitment: 3 months.
- Tacit renewal for monthly periods.
- Cancellation with one month's notice.
When the monthly subscription is taken out during the month, :
- Subscriptions are calculated from the 1st day to the last day of each calendar month, regardless of the subscription date.
- In the event of subscription during the month, the first payment is calculated on a pro rata basis for the days remaining until the end of the current month.
- The subscription ends on the last day of the calendar month (30th or 31st depending on the month) of the last month of the commitment; in this case, the last month is invoiced in full; even if the subscription is cancelled or expires during the month.
2.2 - Terms of payment
- Annual subscription: cash payment on registration, by bank transfer, online payment, credit card (VISA, Mastercard, Amex) or cash.
- Monthly subscriptions: The first month is paid on site at the time of registration (payment by credit card or cash only). Subsequent months are paid by SEPA direct debit, based on the bank details provided on registration.
2.2.1 - Online payment - for annual subscriptions only
The annual subscription to the Club de sport & spa de la Fondation can be paid online, via a secure payment platform.
Payment is made by credit card (Visa, MasterCard, etc.) or any other means specified at the time of ordering, via our payment service provider : Verifone.
Verifone ensures payment security using SSL and 3D Secure protocols.
No banking data is stored by the Club de sport & spa de la Fondation. All transactions are processed directly by the secure payment platform. By validating payment, the member (Customer or Member) acknowledges having read and accepted these General Terms and Conditions of Sale. The transaction is final once payment has been confirmed by the bank.
In accordance with the provisions of article L221-18 of the French Consumer Code, the consumer has a period of fourteen (14) days from the date of the online order to exercise his or her right of withdrawal, without justification or additional costs except those provided for by law.
To do so, simply send a registered letter with acknowledgement of receipt, to 29 rue de Saussure, 75017 Paris, expressing without ambiguity his or her wish to withdraw. A model retraction form is available on request.
According to article L221-28 of the French Consumer Code, the right of withdrawal does not apply:
- Services already performed before the end of the period, with the Member's express agreement and waiver;
- Leisure or wellness activities (group classes, treatments, coaching sessions, etc.) scheduled for a specific date or period.
2.3 - Overriding clause: - Subscriptions taken out before September 6, 2025
Members who subscribed before September 6, 2025 benefit from specific terms and conditions, distinct from those set out in these General Terms and Conditions of Sale. These special terms and conditions remain applicable to them until their current contract expires, unless they expressly request a change.

3. TERMINATION AND SUSPENSION
3.1 - Termination of contract
The contract may be terminated in the following cases:
3.1.1 - Termination for legitimate reasons
The contract may be terminated at any time in the event of :
- Member's death or disability
- Redundancy or breach of contract (only for annual or monthly subscriptions with a 12-month commitment).
- Transfer or professional move (only for annual or monthly subscriptions with a 12-month commitment).
Requests must be accompanied by proof of entitlement and sent by registered letter with acknowledgement of receipt to : La Fondation Sport & Spa - 29 rue de Saussure, 75017 Paris
In the case of an annual or monthly subscription with a 12-month commitment, a prorata temporis refund may be granted. Monthly subscriptions with a 3-month commitment are non-refundable.
3.1.2 - Termination for fault
The Club de sport & spa de la Fondation may terminate the contract in the event of non-compliance with the Internal Regulations (article 4.3). Such termination shall take effect upon written notification (letter or e-mail). The Member or Customer must return his or her card immediately.
The Member or Customer may be registered in the "incidents" file, in accordance with the French Data Protection Act (n°78-17 of January 6, 1978). The Club de sport & spa de la Fondation reserves the right to claim compensation in the event of prejudice.
3.2 - Temporary suspension of the contract
Members may request a temporary suspension of their membership for a maximum of 6 months, subject to acceptance by the la Fondations Sport & Spa Club.
Accepted reasons include
- Pregnancy
- Injury resulting in temporary inability to engage in physical activity/illness/hospitalization
The request must be justified by an official document (medical certificate, hospitalization, etc.) and sent by registered letter with acknowledgement of receipt to : Club de sport & spa de La Fondation - 29 rue de Saussure, 75017 Paris.
Supporting documents must be submitted before the start of the suspension or within 15 days of the first day of suspension. After this deadline, the request may be refused.
4. ROOM AND SPA ACCESS
4.1 - Opening days and times
The opening days and times of the Club de sport & spa de la Fondation are displayed on the premises and on the website. They may be modified at any time without recourse on the part of the Member. However, the Club de sport & spa de la Fondation reserves the right to close its premises for a maximum of 10 working days per year, without the Member being entitled to claim any compensation or reduction in the price of his/her membership.
4.2 - Membership card and day pass
Access to the Hall is strictly reserved:
- Members with their membership card
- Customers with a day pass
Access will be refused without presentation of one of these documents.
The membership card is issued to the member on the day of definitive registration. In the event of loss or theft, a replacement card will be charged at the rate displayed at the reception desk.
The season ticket is personal and cannot be lent or transferred.
4.3 - Reservations and cancellations
4.3.1 - Members
Online booking is required to take part in a group class, individual coaching or treatment.
Access to group courses :
- Members can book up to 2 group lessons per day, provided they are in different disciplines.
- Exception: Aquagym can be taken 2 times a day, even if the sessions are identical.
Conditions of cancellation and attendance :
- Two unjustified absences per month will result in the account being blocked, preventing any further bookings for a minimum of 15 days.
- Late cancellation of an individual coaching session (less than 12 hours before the start date): the session will be billed in full.
- Late cancellation of a treatment (less than 12 hours before the start date): the treatment will be billed in full.
4.3.2 - Non-member customers
Online booking is also compulsory for courses and treatments.
Cancellations must be made at least 24 hours in advance. After this time, the course or treatment will be invoiced in full.
4.4 Rules and regulations
Access to the Club de sport & spa de la Fondation implies strict compliance with the Internal Regulations, posted at reception. By entering, the Member or Customer acknowledges having read them and undertakes to comply with them in all circumstances.
General rules of conduct, health and safety
The Member or Customer undertakes to :
- Wear clean, appropriate sportswear (no flip-flops, sneakers or jeans)
- Use footwear specifically designed for sports use (prohibited in wetlands).
- Wear a bathing suit and towel in wet areas (swimming shorts permitted; wetsuits and burkini forbidden).
- Take a shower before entering the sauna, steam room or swimming pool
- Use a towel to protect equipment
- Clean your place and your equipment after use with the products provided
- Store equipment after use
- Use equipment (dumbbells, bars, etc.) only in dedicated areas
- Respect schedules: all activities must cease 30 minutes before closing time
Rules specific to courses and treatments
- The coach may refuse access if you are late for a class.
- If you are late for a treatment, it will finish at the scheduled time.
- All treatment bookings must be confirmed by payment (cash, credit card, Amex, bank transfer or via www.lafondation.com).
Restrictions and bans
- Access to the gym is permitted from the age of 16, under parental supervision or upon presentation of written authorization. Memberships and use of the self-service climbing wall are reserved for those over the age of 18.
- The use of personal sports equipment is forbidden without prior authorization.
- It is compulsory to dry off before entering changing rooms or dry areas.
- It is forbidden to shave, depilate or perform dirty body treatments.
- Personal belongings must be stored in lockers and released at the end of the session (except for lockers rented by the year).
- Towels must be returned at the end of the session.
- It is forbidden to eat food near sports facilities, in classrooms and in the SPA.
- Performance-enhancing drugs, alcoholic beverages, and unaccompanied animals are prohibited.
- Telephone use must be discreet; silent mode mandatory in the SPA
- Smoking and vaping are prohibited on the premises.
- Re-enrolment after exclusion is forbidden
Sanctions
Failure to comply with the Internal Regulations may result in :
- Immediate termination of subscription
- Financial penalties, at the discretion of the la Fondations Sports & Spa Club
Additions to the Internal Regulations
All specific instructions posted on the premises, in particular :
- Pool rules
- Equipment operating instructions
- Safety rules for the climbing wall and its equipment
Children's access to the pool:
All children under the age of 16 must be accompanied by their parents or legal guardians.
Access times for children:
- Weekdays: 11:00 a.m. to 12:00 p.m. / 4:00 p.m. to 6:00 p.m.
- Weekends: 11:00 a.m. to 12:00 p.m. / 4:00 p.m. to 6:00 p.m. / 8:00 p.m. to 10:00 p.m.
The facilities, equipment and linen made available to Customers remain the exclusive property of the Club de sport & spa de la Fondation. The Customer is solely responsible for any damage and undertakes to bear the financial consequences thereof.
Any behavior deemed inappropriate - excessive noise, disrespect for staff or other customers, or immoral behaviour - may result in immediate exclusion.
The Internal Regulations may be modified at any time by the Club de sport & spa de la Fondation. Any updates will be communicated to Members and Customers and posted at reception.
4.5 - Specific conditions for access to and use of the climbing wall
4.5.1 - Access and reservation
Access to La Fondation s climbing wall is strictly reserved for Members with a valid membership, and only upon prior reservation via the Club de sport & spa de la Fondation website or mobile app.
Access to the climbing wall is forbidden to minors.
Apart from the courses and training sessions run by the la Fondations Club de sport & spa and supervised by its instructors, climbing is carried out in complete autonomy, with no active supervision or coaching. No lessons or coaching are offered. Each member is fully responsible for his or her own climbing.
4.5.2 - Climbing areas and equipment
The climbing wall is equipped with :
- Of tracks with automatic relays (reels),
- Roped routes with quickdraws, accessible to lead climbing and top-roping.
Each lane is clearly identified according to the type of practice permitted.
4.5.3 - Access conditions
To access the climbing area, Members must :
- Have signed a Declaration of Climbing and Belaying Autonomy, specifically mentioning the types of climbing authorized (top-rope and/or top-roping),
- Have signed a waiver of responsibility for independent practice,
- Be over 18 years of age
- Use the correct equipment (harness, ropes, quickdraws, belay devices),
- Strictly comply with posted safety instructions.
Otherwise, access will be denied.
The Club de sport & spa de la Fondation reserves the right to re-evaluate the declared autonomy in the event of any doubt regarding the Member's behavior.
4.5.4 - Safety rules
The Member undertakes to :
- Use only the equipment intended for each type of route (automatic belay or rope route),
- Systematically check your equipment before each climb (harness, rope, belay, carabiner, knots),
- Respect specific safety protocols for lead climbing: dynamic belay, constant supervision, clips in successive quickdraws,
- Immediately report any anomaly or damaged equipment to the La Fondation team.
Climbing shoes or closed sports shoes must be worn when climbing.
It is strictly forbidden to:
- Climbing without ropes or approved equipment,
- The use of equipment external to the la Fondations Sports & Spa Club.
- Repeated voluntary falls (flights must be accidental and controlled),
- Parking in the fall zone or under a lead climber,
- Incorrect tying (knot not properly tied or positioned).
Climbers are warned that some holds may twist or come loose. Constant vigilance is required, both for the climber and the belayer.
4.5.5 - Liability and exclusions related to climbing
Each member is entirely responsible for his or her own climbing.
La Fondation declines all responsibility for accidents caused by :
- Failure to comply with safety regulations
- Improper use of equipment,
Erroneous declaration of autonomy. La Fondation reserves the right to suspend or exclude any Member:
- Not following safety instructions,
- behaving in a way that puts himself or a third party at risk,
- Or using the facilities in a non-compliant manner.
No compensation can be claimed in the event of exclusion.
Members are strongly advised to take out individual insurance to cover the risks associated with climbing (notably death, disability and injury).
5. GENERAL LIABILITY
5.1 - Fitness for sporting activities
Each member or customer is responsible for his or her own fitness to practice a sport, receive a treatment or use the wetlands.
It's up to him to judge its suitability before each session.
Spa treatments and facilities are not recommended for people with health problems, unless medical advice has been obtained.
Clients are asked to inform the staff of any special medical conditions prior to treatment.
The practice of aerial yoga and the use of the Hammam & Sauna are not recommended for pregnant women or people with heart problems.
In the event of inaptitude, the Customer agrees not to hold the Club de sport & spa de la Fondation liable in any way whatsoever.
5.2 - Insurance and liability of the Club de sport & spa de la Fondation
The Club de sport & spa de la Fondation is covered by civil liability insurance in accordance with article L.321-1 of the Code du Sport, which also covers its staff and customers.
The Club de sport & spa de la Fondation cannot be held responsible for accidents resulting from :
- failure to comply with safety instructions,
- or misuse of equipment or installations
In accordance with article L.321-4 of the French Sports Code, the Club de sport & spa de la Fondation informs the Member and the Customer of the benefits of taking out a personal insurance policy covering bodily injury in connection with their sporting activities.
The la Fondation s Sports & Spa Club is insured by Axa :
- A civil liability policy under no. 11292111804
- A multi-risk policy under no. 112862242004.
5.3 - Security of personal effects
La Fondation provides the Member with a locker for storing personal belongings. The Member is responsible for its use and must close it using the device provided.
For safety and respect of the premises:
- Personal belongings must be stored exclusively in a locker.
- It is forbidden to leave personal belongings in lockers after leaving the facility. Lockers are emptied every evening for hygiene and safety reasons.
- The Club de sport & spa de la Fondation declines all responsibility in the event of theft or loss.
INFORMATION AND FREEDOM
6.1 - Personal data
Member data is collected by the la Fondation Sport & Spa Club for :
- subscription management,
- and subject to consent, offers and news
La Fondation shares data solely for its own purposes with third parties acting on behalf of La Fondation, for example for credit card payments, hosting of Customer data, e-mail distribution, debt collection. Member data is kept for as long as necessary to achieve the purposes set out above, unless a longer retention period is required by applicable law. Pursuant to the French Data Protection Act of January 6, 1978, as amended, and the General Data Protection Regulation (EU) n°2016/679 of April 27, 2016 ("RGPD"). The Member has a right of access, modification, rectification, deletion, portability and opposition that may be exercised by sending a request accompanied by proof of identity to La Fondation - 29 Rue de Saussure 75017 Paris.
6.2 - Monitoring, video surveillance
The Club de sport & spa de la Fondation is under video surveillance 24/7. This data is stored for a maximum of 1 month, after which it is automatically erased and destroyed by the IT management system (French Data Protection Act of 6 January 1978, amended in 2024).
6.3 - Obligation to provide information on the BLOCTEL system (Art L223-2 Consumer Code)
"When a professional collects telephone data from a consumer, he informs the consumer of his right to register on the opposition list against telephone canvassing. When this information is collected at the time of concluding a contract, the contract must mention, in a clear and comprehensible manner, the existence of this right for the consumer."
It is possible to register free of charge on the BLOCTEL telephone anti-spam list, managed by OPPOSOTEL under a public service delegation agreement.
6.4 - Disputes or claims
In the event of a dispute or claim, after contacting the management of the la Fondations Sports Club & Spa, and failing a mutually satisfactory response, the Customer or Member may, within a reasonable time, refer the matter to the Mediator: www.mediationconso-ame.com.
