The present General Terms and Conditions of Sale (GTCS) apply in their entirety and without reservation to all subscriptions concluded by the Club de sport & spa de la Fondation with Customers and Members; to which will be annexed an individual subscription contract for each Member.
The General Sales Conditions and the subscription contract are inseparable.
This Agreement sets out the terms and conditions under which the Club de sport & spa de la Fondation grants Members and Customers access to the gym and climbing wall for individual sports activities, with a coach and/or as part of group classes led by qualified sports advisors; as well as access to the SPA, which includes a swimming pool, steam room and sauna.
In addition, fee-paying treatments can be booked at the SPA, as well as individual coaching sessions.
Within the framework of the membership formulas defined in this Contract, the Member may access the Gym and SPA according to the opening hours displayed at reception, and take part in group classes. Any participation in a class must be reserved in advance on the website of the Salle de le Club de sport & spa de la Fondation , according to a non-contractual schedule.
The Club de sport & spa de la Fondation reserves the right to modify its terms and conditions of sale and to inform the Customer within a reasonable period of time.

2. CONTRACT DURATION AND PAYMENT METHOD
2.1-Duration
The Club de sport & spa de la Fondation offers three membership packages:
1. 12-month annual subscription
One-year firm commitment.
-Valid for 12 months only.
2. monthly subscription - 12-month commitment
-Initial commitment: 12 months.
Tacit renewal for one-month periods
-Members may choose not to renew their subscription by giving 2 months' notice before the anniversary date.
3. monthly subscription - 3-month commitment
-Initial commitment: 3 months.
Tacit renewal for one-month periods.
-Members may choose not to renew their subscription by giving 1 month's notice before the anniversary date.
As part of a monthly subscription, taken out during the month
- Subscriptions are calculated from the 1st day to the last day of each calendar month.
- In the event of subscription during the month, the first payment is calculated on a pro rata basis for the days remaining until the end of the current month.
The subscription ends on the last day of the calendar month (30th or 31st depending on the month) of the last month of the commitment. In this case, the last month is billed in full, even if the subscription is cancelled or expires during the month.
2.2 - Method of payment
- Annual subscription: cash payment at time of registration, by bank transfer, online payment, credit card (VISA, Mastercard, Amex) or cash.
- Monthly subscriptions :
- The first month is paid on site at registration (payment by credit card or cash only).
- Subsequent months are paid by SEPA direct debit, based on the bank details provided at the time of registration.
As part of a monthly subscription, taken out during the month
- Subscriptions are calculated from the 1st day to the last day of each calendar month.
- In the event of subscription during the month, the first payment is calculated on a pro rata basis for the days remaining until the end of the current month.
- The subscription ends on the last day of the calendar month (30th or 31st depending on the month) of the last month of the commitment. In this case, the last month is billed in full, even if the subscription is cancelled or expires during the month.
2.2.1 - Online payment - for annual subscriptions only
Payment for annual memberships to Le Club de sport & spa de la Fondation can be made online, via a secure payment solution.
Online payments are made by credit card (Visa, MasterCard, etc.) or any other means specified during the order process, via our payment service provider : Verifone.
This service provider ensures payment security in accordance with current standards, in particular via the SSL protocol and the 3D Secure system.
No banking information is kept by the Club de sport & spa de la Fondation.
All transactions are processed directly by the secure payment platform.
By validating payment, the member (Customer or Member) acknowledges having read and accepted the present General Terms and Conditions of Sale. The transaction is considered final once payment has been confirmed by the bank.
In accordance with the provisions of article L221-18 of the French Consumer Code, the consumer has a period of fourteen (14) days from the date of conclusion of the contract (validation of the online order) to exercise his right of withdrawal, without having to give reasons for his decision or bear any costs other than those provided for by law.
To exercise this right, the member may send a registered letter with acknowledgement of receipt to 29 rue de Saussure, 75017 Paris, expressing his or her unambiguous wish to withdraw. A model withdrawal form is available on request.
In accordance with article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for :
- Services fully performed before the end of the withdrawal period and whose performance has begun after the consumer's express prior agreement and express waiver of his right of withdrawal;
- Leisure or wellness activities (group courses, treatments, coaching sessions, etc.) that must be provided on a specific date or at a specific time.
2.3 Override clause - Subscriptions taken out before September 6, 2025
Members who subscribed before September 6, 2025 benefit from specific terms and conditions, distinct from those set out in these General Terms and Conditions of Sale. These special terms and conditions remain applicable to them until their current contract expires, unless expressly modified by them. 3. TERMINATION
3.1-Cancellation or suspension for medical, professional or force majeure reasons
For the first year, the present contract constitutes a firm and definitive commitment for 12 consecutive months, not subject to any right of early termination. However, and only as listed below, the subscription may be terminated at any time:
- Major health reasons: death and/or disability on presentation of supporting documents
- Redundancy or contractual termination
- Transfer and professional relocation
In such cases, the member will be reimbursed the amount of the annual subscription on a prorata temporis basis.
3.2 - Termination for fault
The Club de sport & spa de la Fondation reserves the right to terminate the Member's membership contract for failure to comply with any of the provisions of the following Internal Regulations (art. 4.3). Such termination shall be effective upon receipt of a written notice (letter or e-mail) sent to the Member. In the event of termination for fault, the Member must return his or her card immediately to the Club de sport & spa de la Fondation.
This provision also applies to the Customer, who undertakes to comply with the Internal Regulations.
In this case, the Member or Customer will be registered in the "incidents" litigation file established by the Club de sport & spa de la Fondation in compliance with the provisions of law no. 78-17 of January 6, 1978, known as the "Informatique et Libertés" law. The Club de sport & spa de la Fondation also has the right to claim compensation from the Member or Customer for any prejudice suffered.
3.3 - Suspension
Exceptionally, and at the discretion of the la Fondations Sports & Spa Club, the Member may request a temporary suspension of his or her contract for a maximum of 6 months. Cases of suspension include, but are not limited to, pregnancy, injury or any condition that temporarily prevents physical activity. However, the Member must justify his or her request for suspension by presenting valid proof (medical certificate, hospitalization certificate, death certificate, etc.), sent by registered letter with acknowledgement of receipt to the following address: La Fondation Sport et Spa - 29 Rue de Saussure, 75017 Paris. These supporting documents must be sent before the interruption or within a maximum of 15 days from the first day of interruption. Failure to do so will result in refusal of the suspension request.
4. ROOM AND SPA ACCESS
4.1 - Opening days and times
The opening days and times of the Club de sport & spa de la Fondation are posted on the premises and on the website. They may be modified as stated above without recourse by the Member.
However, the Club de sport & spa de la Fondation reserves the right to close its premises for a maximum of 10 working days per year, without the Member being entitled to claim any compensation or reduction in the price of his/her membership.
4.2 - Membership card and day pass
Access to the Clubhouse is strictly reserved for Members with their card and Clients with a day pass, which is mandatory for access to the Clubhouse and SPA; otherwise, access will be refused la Fondation
The membership card is issued to the member on the day of definitive registration. In the event of loss or theft, a replacement card will be charged at the rate displayed at the reception desk.
The season ticket is personal and cannot be lent or transferred.
4.3 - Booking and cancellation conditions
4.3.1 For Members
All courses and treatments must be booked in advance via the website.
Each member has access to a maximum of two group classes per day, provided they are in different disciplines.
Exception: Aquagym can be taken up to 2 times a day, even if the sessions are of the same nature.
- Two monthly no-shows for group lessons will result in the Member's account being blocked, and he/she will no longer be able to book lessons.
- In the event of late cancellation of individual coaching, i.e. less than 12 hours before the start of the course, the course will be invoiced in full.
- In the event of late cancellation of a treatment, i.e. less than 12 hours before the start of the treatment, the treatment will be billed in full.
4.3.2 For non-Member customers
All courses and treatments must be booked in advance via the website.
All cancellation requests must be made within 24 hours of the treatment or course (individual or group).
After this time, the course or treatment will be billed in full.
4.4 - Internal regulations
Access to the Club de sport & spa de la Fondation requires strict compliance by the Member and/or Customer with the Internal Regulations, posted at reception. The Member and/or Customer acknowledges having read them and undertakes to comply with them in all circumstances.
The Member and/or Customer undertakes to comply with the following rules of good conduct, hygiene and safety:
- Wear proper, clean sportswear for sporting activities; flip-flops, sneakers and jeans are not permitted.
- Sports shoes used in the hall must be reserved for this purpose only and are forbidden in the water areas.
- Bathing suits and towels must be worn to access wet areas. Swimming shorts are accepted. Wearing a wetsuit or burkini is forbidden.
- A shower is mandatory before using the facilities (sauna, hammam, swimming pool).
- The use of a towel to protect the hall's facilities is compulsory.
- It is compulsory to clean your place and your equipment after use, using the cleaning products provided.
- Equipment must be put away after use.
- Dumbbells, bars, discs and other sports equipment may be used in dedicated areas only.
- The coach reserves the right to refuse access to the Member in the event of lateness to a class.
- If you are late for a treatment, the service will end at the originally scheduled time.
- All treatment bookings must be made in advance and confirmed by payment (cash, credit card, Amex, bank transfer or via the website: www.lafondation.com).
- The use of personal sports equipment on club premises is strictly forbidden without prior authorization from the management.
- It is compulsory to dry off in the wet areas before entering the changing rooms or any other dry area.
- Shaving, waxing and other messy body treatments are prohibited.
- Bags and personal belongings must be stored in lockers in the changing rooms.
- Lockers must be vacated at the end of the session, with the exception of lockers rented by name on a yearly basis; the Club de sport & spa de la Fondation reserves the right to open any locker that has not been vacated for safety and hygiene reasons.
- The loaned towel must be returned at the end of the session.
- It is forbidden to consume food in the vicinity of sports facilities, in rooms dedicated to group classes, and in the SPA.
- It is forbidden to use or circulate doping products.
- Alcoholic beverages may not be brought in.
- Pets are not allowed in the la Fondations Sports & Spa Club.
- Unaccompanied minors are not allowed access to the areas.
- The use of cell phones must be limited in order to preserve the tranquillity of the premises, and must be on silent mode within the spa.
- Smoking and vaping (electronic cigarettes) are prohibited on the premises.
- It is mandatory to stop all activities no later than 30 minutes before the closing time of the Club de sport & spa de la Fondation.
- It is forbidden to re-register after an exclusion.
Failure to comply with these rules will result in automatic termination of membership and/or penalties, at the discretion of the la Fondations Sports & Spa Club.
All specific instructions posted in the Club de sport & spa de la Fondation are also considered to be an integral part of the Internal Regulations, i.e.: swimming pool rules, machine operating instructions, safety rules for use of the climbing wall and climbing wall equipment.
Please note that the facilities, equipment and linen made available to customers remain the exclusive property of the Club de sport & spa de la Fondation.
The customer remains solely responsible for any damage to the facilities, equipment and linen, and is obliged to assume the financial consequences.
Finally, any behavior deemed inappropriate, such as excessive noise, disrespect for staff or other customers, or inappropriate behavior contrary to good morals, will result in immediate exclusion.
The present Internal Regulations may be modified at any time by the Club de sport & spa de la Fondation, and Members and Customers will be informed of such modifications by means of a notice posted on the premises of the Club de sport & spa de la Fondation.
4.5 - Specific conditions of access and use of the climbing wall
4.5.1. Access and reservation
Access to La Fondation 's climbing wall is strictly reserved for Members with a valid membership, and only upon prior reservation via La Fondation's website or mobile application. Access to the climbing wall is forbidden to minors.
Apart from the courses and training provided by La Fondation and supervised by its instructors, climbing is carried out in complete autonomy, with no active supervision. No courses or coaching are offered. All climbing members must therefore be fully autonomous and responsible.
4.5.2 Climbing zones and devices
The climbing wall is equipped with :
- Of tracks with automatic relays (reels),
- Roped routes with quickdraws, accessible to lead climbing and top-roping.
Each lane is clearly marked according to the type of practice permitted.
4.5.3 Access conditions
Any Member wishing to access the climbing area must :
- Have signed a Declaration of Climbing and Belaying Autonomy, specifically mentioning the types of climbing authorized (top-rope and/or top-rope),
- Have signed a waiver of responsibility for independent practice,
- Be over 18 years of age
- Use the correct equipment (harness, ropes, quickdraws, belay devices),
- Strictly comply with posted safety instructions.
No access will be granted without these prerequisites. Declared autonomy may be re-evaluated by the la Fondations Sport & Spa Club if there is any doubt about observed behavior.
4.5.4 Safety rules
The Member undertakes to :
- Use only the equipment intended for each type of route (automatic belay or rope route),
- Systematically check your equipment before each climb (harness, rope, belay, carabiner, knots),
- Respect safety protocols specific to lead climbing: dynamic belay, constant supervision, clips in successive quickdraws,
- Immediately report any anomaly or damaged equipment to the La Fondation team.
It is strictly forbidden to:
- Climbing without ropes or approved equipment,
- Use personal equipment not verified by La Fondation,
- Repeated voluntary falls (flights must be accidental and controlled),
- Parking in the fall zone or under a lead climber,
- Incorrect tying (knot not properly tied or positioned).
Climbers are informed that holds may turn or come loose. They must therefore remain vigilant, as must their insurers, at all times.
4.5.5 Liability and exclusions
Each member is fully responsible for his or her own use of the equipment. La Fondation declines all responsibility in the event of an accident resulting from failure to comply with the rules, improper use of equipment, or an erroneous declaration of autonomy.
La Fondation reserves the right to suspend or exclude any Member:
- who does not comply with safety instructions,
- whose behavior poses a risk to themselves or others,
- or inappropriate use of the facilities.
No compensation can be claimed in the event of exclusion.
Members are strongly advised to take out individual insurance to cover the risks associated with climbing (notably death, disability and injury).
5. RESPONSIBILITY
5.1 - Fitness for sporting activities
Customers and Members are advised to check their fitness to practice a sport and/or administer a treatment or use the wetland.
The Customer or Member must assess his or her suitability before each session.
The spa's treatments and facilities are not recommended for people with health problems, unless prior medical advice has been obtained.
Clients are asked to inform the staff of any special medical conditions prior to treatment.
Aerial yoga and use of the Hammam & Sauna are not recommended for pregnant women or people with heart problems.
In the event of inaptitude, the Customer agrees not to hold the Club de sport & spa de la Fondation liable in any way whatsoever.
5.2 - Insurance
The Club de sport & spa de la Fondation is insured for damages involving its civil liability and that of its staff and clients in accordance with article L.321-1 of the French Sports Code.
The Club de sport & spa de la Fondation shall not be held liable for any accident resulting from the Member's or Customer's failure to observe safety instructions or from inappropriate use of the equipment or other facilities. No recourse may be taken against the Club de sport & spa de la Fondation.
In accordance with article L.321-4 of the French Sports Code, the Club de sport & spa de la Fondation informs the Member and the Customer of the benefits of taking out a personal insurance policy covering bodily injury to which their sporting activities may expose them, with the insurer of their choice.
La Fondation has taken out a civil liability policy with Axa under number 11292111804 and a multi-risk policy under number 112862242004.
5.3 Security of personal effects
La Fondation provides Members with a locker for their personal belongings. Members are responsible for its use, and must lock it with a padlock of their choice. For reasons of security and respect for the premises, personal belongings must be stored in a locker only. The Club de sport & spa de la Fondation does not supervise locker rooms and common areas, and will not be held responsible in the event of theft or loss.
For security reasons, it is forbidden to leave personal belongings inside lockers after leaving the facility.
6. INFORMATION TECHNOLOGY AND CIVIL LIBERTIES
6.1 Personal data
Members' data is collected by the Club de sport & spa de la Fondation to manage their membership, and subject to their consent, to send them offers and news from La Fondation. La Fondation shares data solely for its own purposes with third parties acting on behalf of La Fondation, for example for credit card payments, customer data hosting, e-mail distribution and debt collection. Member data is kept for as long as necessary to achieve the purposes set out above, unless a longer retention period is required by applicable law. Pursuant to the French Data Protection Act of January 6, 1978, as amended, and the General Data Protection Regulation (EU) n°2016/679 of April 27, 2016 ("RGPD"). The Member has a right of access, modification, rectification, deletion, portability and opposition that may be exercised by sending a request accompanied by proof of identity to La Fondation - 29 Rue de Saussure 75017 Paris.
6.2 Monitoring, video surveillance
The Club de sport & spa de la Fondation is under video surveillance 24/7. This data is stored for a maximum of 1 month, after which it is automatically erased and destroyed by the IT management system (French Data Protection Act of 6 January 1978, amended in 2024).
6.3 Obligation to provide information on the BLOCTEL system (Art L223-2 Consumer Code)
"When a professional collects telephone data from a consumer, he informs the consumer of his right to register on the opposition list against telephone canvassing. When this information is collected at the time of concluding a contract, the contract must mention, in a clear and comprehensible manner, the existence of this right for the consumer."
It is possible to register free of charge on the BLOCTEL telephone anti-spam list, managed by OPPOSOTEL under a public service delegation agreement.
6.4 Disputes or complaints
In the event of a dispute or claim, after contacting the management of the la Fondations Sports Club & Spa, and failing a mutually satisfactory response, the Customer or Member may, within a reasonable time, refer the matter to the Mediator: www.mediationconso-ame.com.
