1. Purpose of the Contract
These General Terms and Conditions of Sale (hereinafter the “GTC” or “General Terms and Conditions of Sale”) apply in their entirety and without reservation to all subscriptions entered into by the la Fondation Sports & Spa Club la Fondation Customers and Members; they are an integral part of the membership agreement (hereinafter the “Agreement” signed by each Member).
The General Terms and Conditions of Sale set forth the terms and conditions for access to la Fondation Sports & Spa Club la Fondation they authorize Members and/or Customers to use the gym and climbing wall for individual sports activities, as well as for group classes led by certified fitness instructors; access to the spa is also included, featuring a swimming pool, a steam room, and a sauna.
In addition, paid treatments can be booked at the spa, as well as individual coaching sessions, exclusively with La Fondation coaches. As part of the membership plans outlined in these Terms and Conditions, La Fondation de Sport & Spa provides Members with an access card to use the gym and spa during the hours posted at the front desk, and to participate in group classes.
All class participation requires a mandatory advance reservation on the la Fondation Sports & Spa Club website, la Fondation a subject-to-change and non-binding schedule.
la Fondation 's Sports & Spa Club la Fondation the right to modify these Terms and Conditions at any time.
The Member will be notified of any changes by any means. In the event of a substantial change, the Member may cancel their subscription at no cost within thirty (30) days.
The Sports & Spa Club reserves the right to modify, adjust, or discontinue, at any time, all or part of the services offered—including equipment, facilities, group classes, schedules, or instructors—based on operational constraints.
These changes shall not give rise to compensation, provided that they do not affect the essential nature of the services purchased.

2. SUBSCRIPTION PLANS AND PAYMENT TERMS
2.1 — Subscription Plans
The Club de sport & spa de la Fondation offers three membership packages:
Annual subscription — 12-month commitment — one-time payment
. Firm 12-month commitment.
. Automatic cancellation upon expiration of the 12-month term; no automatic renewal.
Monthly subscription — 12-month commitment — monthly payment
. Firm 12-month commitment.
. Automatic cancellation upon expiration of the 12-month term, with no automatic renewal.
Monthly subscription — 3-month commitment — monthly payment
Initial commitment: 3 months.
At the end of the 3-month period , the subscription is automatically renewed on a monthly basis; however, it may be canceled at any time with one (1) month’s notice.
Terms and Conditions for Monthly Subscriptions
Subscription fees are calculated from the first day to the last day of each calendar month, regardless of the subscription date. If a subscription is purchased mid-month, the first payment is prorated based on the number of days remaining until the end of the current month.
The subscription ends on the last day of the calendar month (the 30th or 31st, depending on the month) of the final month of the subscription period; in this case, the final month is billed in full, even if the subscription is canceled or expires during the month.
Re-registration
If a Subscription is canceled and then renewed, the Member will be subject to the pricing and contractual terms in effect on the date of renewal. Previous terms (including those regarding flexibility and pricing) will not be carried over.
2.2 — Payment Terms
Annual subscription — 12-month commitment — full payment: full payment due on the day of registration, via bank transfer, online payment, credit card (VISA, Mastercard, Amex), or cash.
Monthly subscription — 12-month commitment — monthly payment: The first month’s payment is due on the day of registration (payment by credit card or cash only). Subsequent months are paid via SEPA direct debit, using the bank details provided at the time of registration. The SEPA direct debit authorization must be provided on the day of registration.
Monthly subscription — 3-month commitment — monthly payment: The first month’s payment is due upon registration (credit card or cash only). Subsequent months are paid via SEPA direct debit using the bank details provided at registration.
The member agrees to notify the la Fondation Sports & Spa Club la Fondation any changes to their bank account information (RIB/IBAN) as soon as possible and no later than the first day of the following month so that the SEPA direct debit mandate can be updated,
Otherwise, any payment issue may result in the suspension of the subscription in accordance with the terms of Section 2.3.3 herein and the imposition of administrative fees.
2.2.1 — Online payment — for the annual subscription, cash payment only
Theannual membershipfor la Fondation Sports & Spa Club la Fondation be paid for online via a secure payment platform.
Payment can be made by credit card (Visa, MasterCard, etc.) or any other method specified at the time of ordering, through our payment service provider: Verifone. Verifone ensures payment security using SSL and 3D Secure protocols.
By confirming payment, the subscriber (Customer or Member) acknowledges that they have read and accepted the Terms and Conditions of Sale.
The transaction is final once payment has been confirmed by the bank. In accordance with the provisions of Article L221-18 of the Consumer Code, the consumer has fourteen (14) days from the date of the online order to exercise their right of withdrawal, without justification and at no additional cost other than those provided for by law.
To do so, simply send a registered letter with return receipt requested to 29 rue de Saussure, 75017 Paris, clearly stating your intention to cancel. A sample cancellation form can be provided upon request.
According to article L221-28 of the French Consumer Code, the right of withdrawal does not apply:
• Services already provided before the deadline, with the Member’s express consent and waiver;
• Leisure or wellness activities (group classes, treatments, coaching sessions, etc.) scheduled for a specific date or time period.
2.3 — Credit History, Delinquent Payments, and Debt Collection
2.3.1 — Banking footprint
Upon registration, the la Fondation Sports & Spa Club la Fondation Members or Customers to provide a credit card authorization using a valid card to guarantee payment for membership fees, services, penalties, or any damage caused.
This bank statement does not constitute a payment and will not result in an immediate charge.
It is retained for the entire duration of the Contract and automatically deleted upon its expiration, provided there are no outstanding payments or pending disputes.
2.3.2 — Unpaid amounts, fees, and late payment penalties
Any payment not made by its due date is considered overdue.
Any payment not made by the due date automatically incurs late payment interest at the statutory rate.
Collection fees incurred by La Fondation bank fees, reminder fees, administrative fees) may be billed to the Member and are listed on each invoice. These fees are due and payable immediately.
2.3.3 — Suspension of the subscription in the event of non-payment
If a formal notice remains unanswered for more than eight (8) days from the date of receipt, the la Fondation Sports & Spa Club la Fondation entitled, after this period has elapsed, to suspend the membership without further notice or compensation.
During the suspension period:
• Access to the gym, spa, group classes, climbing wall, and all other services is strictly prohibited;
• All payments remain due in full.
Reactivation of the subscription is contingent upon full payment of all amounts due, including any bank fees, administrative fees, and late payment penalties.
2.3.4 — Termination for Nonpayment and Debt Collection
If, following a period of thirty (30) days from the date of any unsuccessful formal notice to comply with the terms and obligations of la Fondation General Terms and Conditions of Sale, the la Fondation Sports & Spa Club la Fondation the right to terminate the Contract automatically, without prejudice to any amounts owed.
la Fondation Sports & Spa Club la Fondation initiate any appropriate collection proceedings, whether through amicable settlement or legal action. The costs incurred in collecting amounts owed may be charged to the Member or Customer, within the limits set forth by applicable regulations.
3. TERMINATION AND SUSPENSION
3.1 — Cancellation of the Subscription
3.1.1 — Termination by the Member
(a) For valid cause during the commitment period
The Member may request early termination of their Contract during the commitment period only in the following cases:
• Death, disability, or permanent incapacity of the Member exclusively (the death of a family member does not constitute a valid reason);
• Termination or mutual termination (only for annual or monthly subscriptions with a 12-month commitment);
• Only for job transfers or work-related moves (applicable only to annual or monthly subscriptions with a 12-month commitment).
A personal move does not constitute a valid reason for resignation during the employment period. The request must be accompanied by supporting documentation from a third party and sent by certified mail with return receipt requested to: La Fondation & Spa — 29 rue de Saussure, 75017 Paris.
For annual subscriptions or monthly subscriptions with a 12-month commitment, a pro-rata refund may be granted; monthly subscriptions with a 3-month commitment are non-refundable.
b) Cancellation after the initial commitment period – Monthly subscription with a 3-month commitment only
Atthe end of the initial subscription term, the Member may terminate the Contract at any time by providing one (1) month’s notice via certified mail with return receipt requested sent to la Fondation Sports & Spa Club.
3.1.2 — Termination by La Fondation
(a) Upon expiration
Upon expiration of the subscriptions referred to in Article 2 – Subscription Plan
(b) For breach of contract
la Fondation Sports & Spa Club la Fondation the right to terminate the Contract automatically in the event of a material breach, including:
• Outstanding payment not settled in accordance with the terms set forth in Section 2.3;
• Failure to comply with the provisions of the Internal Regulations set forth in Section 4.4. This termination takes effect upon receipt of written notice (by registered mail or email).
The Member or Customer must return their access card immediately.
The Member or Customer may be added to the “incidents” file, in accordance with the French Data Protection Act (No. 78-17 of January 6, 1978). The la Fondation Sports & Spa Club la Fondation the right to seek compensation in the event of damage.
3.2 — Temporary Suspension of the Agreement
3.2.1 — Suspension at the Member’s request
Members may request a temporary suspension of their membership for a minimum of one (1) month and a maximum of six (6) months, subject to approval by the la Fondation Sports & Spa Club.
Accepted reasons include
• Pregnancy;
• Injury resulting in temporary inability to engage in physical activity, illness, or hospitalization.
The request must be supported by documentation from a third party (medical certificate, proof of hospitalization, etc.) and sent by certified mail with return receipt requested to: Club de sport & spa de La Fondation 29 rue de Saussure, 75017 Paris.
This provision will take effect only upon confirmation of the suspension by la Fondation Sports & Spa Club la Fondation will not result in a retroactive suspension or a refund for the current month. Supporting documentation must be submitted before the suspension begins or within fifteen (15) days of the first day of absence; after this period, the request may be denied.
The temporary suspension provided for in this section applies only to 12-month contracts; 3-month contracts are excluded.
During the suspension period, monthly payments will continue to be processed. In return, the subscription period will be extended by a period equal to the duration of the suspension.
3.2.2 — Suspension by La Fondation non-payment
The conditions for suspending a membership due to non-payment are governed by Section 2.3.3 of these Terms and Conditions. 4. ACCESS TO THE GYM AND SPA
4.1 — Days and hours of operation
The opening days and hours of la Fondation Sports Club & Spa la Fondation posted on the premises and on the website. They may be changed at any time without recourse on the part of the Member.
4.2 – Temporary closure
la Fondation Sports & Spa Club la Fondation be required to temporarily close all or part of its facilities for technical, safety, maintenance, renovation, or exceptional event-related reasons. In the event of temporary unavailability not exceeding thirty (30) consecutive days, no compensation may be claimed. Beyond this period, the Member may request, on a commercial basis, a suspension or extension of their membership, to the exclusion of any other compensation.
4.3 — Membership Card and Day Pass
Access to the Hall is strictly reserved:
• Members with their membership cards;
• For customers with a day pass.
Failure to present one of these forms of identification will result in denial of access. Members must present their access card each time they enter the premises. If a member forgets their card, La Fondation a replacement card, which will automatically invalidate the original card. Starting with the third replacement card, each replacement will be charged at €30 per card.
The membership card is personal and may not be lent or transferred to another person. Any violation of this rule entitles the la Fondation Sports Club la Fondation charge the Member 150 euros, corresponding to the current rate for a day pass.
4.4 — Reservations and Cancellations
4.4.1 — Members
Online booking is required to take part in a group class, individual coaching or treatment.
Access to group courses :
• Each member may book up to two group classes per day, provided they are in different disciplines.
• Exception: Aquagym classes may be taken twice a day, even if the sessions are identical.
Conditions of cancellation and attendance :
• Two unexcused absences per month will result in your account being suspended, preventing you from making any new reservations for at least 15 days.
• Late cancellation of an individual coaching session (less than 12 hours before the start): the session will be billed in full.
• Late cancellation of a treatment (less than 12 hours before the start time): the full cost of the treatment will be charged.
4.4.2 — Non-Member Customers
Online reservations are also required for classes and treatments. Any cancellations must be made at least 24 hours in advance. After this time, the class or treatment will be charged in full.
In accordance with our terms and conditions, gift cards are non-refundable.
5. RULES AND REGULATIONS
Access to la Fondation Sports & Spa Club la Fondation strict compliance with the Rules and Regulations, which are posted at the front desk.
By accessing this site, the Member or Customer acknowledges that they have read and understood these terms and agrees to comply with them at all times.
General rules of conduct, health and safety
The Member or Customer undertakes to :
• Wear clean, appropriate athletic clothing (flip-flops, sneakers, and jeans are not allowed);
• Wear shoes intended for sports (not allowed in wet areas);
• Wear a swimsuit and bring a towel in wet areas (swim trunks are allowed; wetsuits and burkinis are prohibited);
• Take a shower before entering the sauna, steam room, or pool;
• Towels must be worn in the steam room, sauna, and common areas of the locker rooms;
• Use a towel to protect the equipment;
• Clean your work area and equipment after use with the supplies provided;
• Put away equipment after use, regardless of which areas were used;
• Use the equipment (dumbbells, barbells, etc.) only in the designated areas;
• Observe the hours: all activities must cease 30 minutes before closing time.
Rules specific to courses and treatments
• The coach may deny entry if you arrive late for a class;
• If you are late for an appointment, it will end at the scheduled time;
• All treatment reservations must be confirmed by payment (cash, credit card, Amex, bank transfer, or via www.lafondationhotel.com).
Restrictions and bans
• The use of personal sports equipment is prohibited without prior authorization;
• You must dry off before entering the locker rooms or dry areas;
• Shaving, hair removal, or any other body care activities that create a mess are prohibited;
• Personal belongings must be stored in lockers and removed at the end of the session (except for lockers rented on an annual basis);
• Lost and found items are held for a maximum of 15 days. After that time, they will be discarded;
• The loaned towel must be returned at the end of the session;
• Eating is not permitted in any of the sports and spa facilities, except for the Juice Bar area;
• The use of glass containers is strictly prohibited in the locker rooms, showers, steam room, sauna, and within the pool area;
• Performance-enhancing drugs, alcoholic beverages, animals, and unaccompanied minors are prohibited;
• Please use your phone discreetly; silent mode is required in the spa;
• Noise from cell phones is prohibited in all sports facilities, the steam room, sauna, pool, and spa, to ensure the comfort of all members and guests;
• Any video recording of common areas must be approved in advance by management;
• Smoking and vaping are prohibited on the premises;
• Re-enrollment after expulsion is prohibited.
Sanctions
Failure to comply with the Internal Regulations may result in :
• Immediate termination of the Agreement without notice;
• Financial penalties, at the discretion of la Fondation’s Sports & Spa Club.
Additions to the Internal Regulations
All specific instructions posted on the premises, in particular :
• Pool rules;
• Equipment user manuals;
• Safety rules regarding the climbing wall and its equipment.
The facilities, equipment, and linens made available to customers remain the exclusive property of la Fondation Sports & Spa Club.
The Customer is solely responsible for any damage and agrees to bear the financial consequences.
Any behavior deemed inappropriate - excessive noise, disrespect for staff or other customers, or immoral behaviour - may result in immediate exclusion.
The Rules and Regulations may be amended at any time by the la Fondation Sports & Spa Club.
Any updates will be communicated to Members and Customers and posted on the homepage.
5.1 — Specific Terms and Conditions for Access to and Use of the Climbing Wall
5.1.1 — Access and Reservations
Access to La Fondation s climbing wall is strictly reserved for Members with a valid membership, and only upon prior reservation via the Club de sport & spa de la Fondation website or mobile app.
Minors are not permitted to use the climbing wall. Except for classes, workshops, and training sessions offered by the la Fondation Sports & Spa Club and supervised by its instructors, climbing is done entirely on one’s own, without any active supervision or guidance. No classes or instruction are provided. Each member is fully responsible for their own climbing activities.
5.1.2 — Climbing areas and equipment
The climbing wall is equipped with :
• Lanes with automatic relays (reels);
• Rope routes with quickdraws, accessible for lead climbing and top-roping, available exclusively as part of group classes led by a state-certified professional.
Each lane is clearly identified according to the type of practice permitted.
5.1.3 — Terms of Access
To access the climbing area, members must:
• Have signed a Declaration of Autonomy for Climbing and Belaying, specifically stating the types of climbing permitted (top-roping and/or lead climbing);
• Have signed a liability waiver for independent practice;
• Be at least 18 years old;
• Use equipment that complies with the club’s standards and is approved by the club (harness, ropes, quickdraws, belay device);
- Strictly comply with posted safety instructions.
Otherwise, access will be denied.
The Club de sport & spa de la Fondation reserves the right to re-evaluate the declared autonomy in the event of any doubt regarding the Member's behavior.
5.1.4 — Safety Rules
The Member undertakes to :
• Use only the equipment intended for each type of route (auto belay or rope route);
• Conduct a thorough check of your equipment before every climb (harness, rope, belay, carabiner, knots);
• Follow the specific safety protocols for lead climbing: dynamic belaying, constant monitoring, clipping into successive quickdraws;
- Immediately report any anomaly or damaged equipment to the La Fondation team.
Climbing shoes or closed-toe athletic shoes must be worn on all routes.
It is strictly forbidden to:
• Climbing without a rope or approved equipment;
• To use equipment from outside the la Fondation Sports & Spa Club la Fondation
• Repeatedly falling on purpose (flights must be accidental and controlled);
• Do not stand in the fall zone or beneath a lead climber;
- Incorrect tying (knot not properly tied or positioned).
Climbers are warned that some holds may twist or come loose. Constant vigilance is required, both for the climber and the belayer.
5.1.5 — Liability and Exclusions Related to Rock Climbing
Each Member is solely responsible for their own independent climbing activities. La Fondation no liability for accidents resulting from:
• Failure to comply with safety rules;
• Improper use of the equipment;
• A false claim of independence.
La Fondation reserves the right to suspend or exclude any Member:
• Failure to follow safety instructions;
• Engaging in behavior that poses a risk to himself or to others;
- Or using the facilities in a non-compliant manner.
No compensation may be claimed in the event of exclusion. It is strongly recommended that each Member purchase personal insurance covering risks associated with rock climbing (including death, disability, and injury).
6. GENERAL LIABILITY
6.1 — Liability of la Fondation Sports Club & Spa
6.1.1 — Insurance
la Fondation Sports & Spa Club la Fondation covered by liability insurance in accordance with Article L.321-1 of the Sports Code, which also covers its staff and customers.
The Club de sport & spa de la Fondation cannot be held responsible for accidents resulting from :
• failure to follow safety instructions;
• or misuse of equipment or facilities.
In accordance with article L.321-4 of the French Sports Code, the Club de sport & spa de la Fondation informs the Member and the Customer of the benefits of taking out a personal insurance policy covering bodily injury in connection with their sporting activities.
la Fondation 's Sports & Spa Club la Fondation insured by Axa:
• A liability insurance policy under number 11292111804;
• A comprehensive insurance policy under policy number 112862242004.
6.1.2 — Limitation of Liability
la Fondation Sports & Spa Club la Fondation bound by an obligation of means with respect to the provision of its facilities and services. It shall not be held liable except in the event of proven negligence, and its liability shall be limited solely to direct damages, excluding any indirect damages, such as, but not limited to, loss of opportunity, loss of business, or commercial loss.
In any event, unless otherwise required by public policy, the Club’s liability for all damages combined is limited to the total amount actually paid by the Member for their membership during the preceding twelve (12) months. This provision does not apply in cases of gross negligence or willful misconduct, nor in cases of bodily injury.
6.2 — Member Liability
6.2.1 — Ability to participate in sports
The Member or Client represents that they are physically fit to engage in sports activities and agrees to consult a healthcare professional if in doubt. The La Fondation Sports and Spa Club La Fondation providing a medical certificate stating that there are no contraindications to participating in sports.
The Member or Customer acknowledges that they engage in the activities offered at their own risk.
The practice of aerial yoga and the use of the Hammam & Sauna are not recommended for pregnant women or people with heart problems.
In the event of incapacity, the Member or Client agrees not to hold the la Fondation Sports Club & Spa liable in any way.
6.2.2 — Security of personal belongings
La Fondation Members with a locker to store their personal belongings. Members are responsible for its use and must lock it using the provided locking mechanism. For safety and to maintain the premises:
• Personal belongings must be stored exclusively in a locker;
• You are not allowed to leave personal belongings in the lockers after leaving the facility.
Lockers are emptied every evening for health and safety reasons. The la Fondation Sports & Spa Club la Fondation no liability for theft or loss.
6.3 — Force Majeure
The Sports & Spa Club shall not be held liable for any failure to perform or delay in performing its obligations resulting from a force majeure event as defined in Article 1218 of the Civil Code.
The following, among others, are considered cases of force majeure, though this list is not exhaustive: natural disasters, fires, pandemics, administrative decisions, mandated closures, strikes, network failures, or any other circumstances beyond the Club’s reasonable control.
In the event of force majeure, performance of the contract shall be suspended for the duration of the event. If the event continues for more than thirty (30) days, either Party may terminate the contract without liability for damages.
7. DATA PROTECTION
7.1 — Personal Data
Member data is collected by the la Fondation Sport & Spa Club for :
• Subscription management;
• And, subject to your consent, the sending of offers and news.
La Fondation data solely for its own purposes with third parties acting on La Fondation behalf, for example for credit card payments, hosting of Customer data, email distribution, and debt collection.
Member data is retained for as long as necessary to fulfill the purposes set out above, unless a longer retention period is required by applicable law.
Pursuant to the amended French Data Protection Act of January 6, 1978, and the General Data Protection Regulation (EU) No. 2016/679 of April 27, 2016 (“GDPR”), the Member has the right to access, modify, rectify, delete, transfer, and object, which they may exercise by sending a request accompanied by proof of identity to La Fondation 29 rue de Saussure, 75017 Paris.
7.2 — Monitoring, video surveillance
la Fondation Sports & Spa Club la Fondation under 24/7 video surveillance.
This data is subject to data protection laws and is stored for a maximum of one month; it is then automatically deleted and destroyed by the IT management system (French Data Protection Act of January 6, 1978, as amended in 2024).
7.3 — Obligation to provide information regarding the BLOCTEL system (Art. L223-2 of the Consumer Code)
“Whena business is required to collect telephone information from a consumer, it must inform the consumer of their right to be added to the do-not-call list. If this information is collected in connection with the conclusion of a contract, the contract must clearly and comprehensibly state that the consumer has this right.”
It is possible to register free of charge on the BLOCTEL telephone anti-spam list, managed by OPPOSOTEL under a public service delegation agreement.
7.4 – Right of Publicity
As part of its promotional activities, La Fondation Sports & Spa Club La Fondation take photographs on its premises. The Member authorizes La Fondation Sports & Spa Club, free of charge, to use his or her image for this purpose, unless he or she expressly objects in writing.
In any case, the information will not be used for specific commercial purposes without explicit consent.
7.5 — Mediation
In accordance with the provisions of Articles L.612-1 et seq. of the French Consumer Code, the Member may, free of charge, seek the assistance of a consumer mediator to resolve a dispute amicably.
